End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("User", "you", or "your") and pub: 2tDev ("we", "our", or "us") for the use of the BCAM- Background Video Recorder mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to these terms, do not download, install, or use the App.

1. License Grant

Subject to the terms of this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use on a single mobile device owned or otherwise controlled by you, strictly in accordance with the App’s documentation.

2. Restrictions

You agree not to, and you will not permit others to:

License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the App or make the App available to any third party.
Copy or use the App for any purpose other than as permitted under the above section ‘License Grant’.
Modify, make derivative works of, disassemble, decrypt, reverse compile or reverse engineer any part of the App.
Remove, alter or obscure any proprietary notice (including any notice of copyright or trademark) of pub: 2tDev or its affiliates, partners, suppliers, or the licensors of the App.

3. Modifications to the App

We reserve the right to modify, suspend or discontinue, temporarily or permanently, the App or any service to which it connects, with or without notice and without liability to you.

4. Term and Termination

This Agreement shall remain in effect until terminated by you or us. We may, in our sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice.

This Agreement will terminate immediately, without prior notice from us, if you fail to comply with any provision of this Agreement. You may also terminate this Agreement by deleting the App and all copies thereof from your mobile device or from your desktop.

Upon termination of this Agreement, you shall cease all use of the App and delete all copies of the App from your mobile device or from your desktop.

5. Subscriptions and Payments

The App offers in-app purchases and subscription services. By purchasing a subscription, you agree to pay the applicable subscription fees and any applicable taxes. If you cancel your subscription, you will still have access to the App for the remaining period of your subscription.

6. Privacy

Your use of the App is also governed by our Privacy Policy, which can be found at [Privacy Policy URL]. By using the App, you consent to the collection and use of your information as outlined in the Privacy Policy.

7. Disclaimer of Warranties

The App is provided to you "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, we expressly disclaim all warranties, whether express, implied, statutory, or otherwise, with respect to the App, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage, or trade practice.

8. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall we or our affiliates, or any of our or their respective licensors or service providers, be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, business interruption, or other commercial damages or losses, arising out of or related to your use or inability to use the App, however caused, regardless of the theory of liability (contract, tort, or otherwise) and even if we have been advised of the possibility of such damages.

9. Indemnification

You agree to indemnify, defend, and hold us and our affiliates, and our respective officers, directors, employees, agents, partners, and licensors (if any) harmless from and against any and all claims, liabilities, damages, losses, costs, expenses, fees (including reasonable attorneys' fees) that arise from your use of the App or your violation of this Agreement.

10. Governing Law

This Agreement and all matters arising out of or relating to this Agreement shall be governed by and construed in accordance with the internal laws of [Your Country/State], without giving effect to any choice or conflict of law provision or rule.

11. Severability

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

12. Entire Agreement

This Agreement constitutes the entire agreement between you and us regarding the use of the App and supersedes all prior and contemporaneous written or oral agreements between you and us.
